CANCELLATION POLICY

Member’s Right to Cancel
Soberano Ventures, Inc.
Doing Business As: Baseline Fitness (“BFIT”)
2nd Floor, Baseline Center, Juana Osmeña Street, Capitol Site, Cebu City 6000, Philippines
Below are the situations where you may cancel your membership and what happens when you do:
1. Cooling-Off Period (New Members)
- New members may cancel their membership within three (3) business days of signing this Agreement.
- A full refund of any dues paid will be issued, except the initiation fee, which is non-refundable.
- Requests must be made in writing within the cooling-off period.
2. Permanent Disability
If you become permanently disabled and can no longer use gym facilities, you may cancel your membership.
- A written medical certification from a licensed physician is required.
- The certification must confirm that you are unable to engage in physical exercise or safely use gym facilities.
- Once approved, your membership will end immediately, and any prepaid dues will be refunded on a prorated basis.
3. Death of the Member
In the unfortunate event of a member’s death, the member’s estate (family or legal representative) may cancel the membership.
- A prorated refund will be provided for any unused portion of prepaid dues.
- Proof of the member’s death will be required to process the refund.
4. Other Life Events (Optional Hold Instead of Cancel)
If you experience a temporary medical condition (e.g., injury, pregnancy) or other life event that prevents gym use, you may request a membership hold/freeze instead of canceling.
- Holds must be requested in advance.
- A small hold fee may apply.
5. How to Request Cancellation
- All cancellation requests must be made in writing (email or signed form at the front desk).
- Your request must include supporting documents if required (e.g., doctor’s note, relocation proof).
- Cancellations are not final until confirmed in writing by Baseline Fitness management.
6. Termination of Membership
Baseline Fitness is committed to providing a safe, welcoming, and inclusive environment for all members, including those who identify as LGBTQIA++. Membership may be suspended (temporary pause) or terminated (permanent end) if a member:
- Violates this Agreement (e.g., fails to pay dues, abuses facilities, brings in outside trainers).
- Engages in disruptive, unsafe, or inappropriate behavior, including harassment, bullying, or intimidation of staff, guests, or other members.
- Displays discriminatory or disrespectful conduct toward any person, including but not limited to race, religion, gender, age, disability, or sexual orientation and gender identity/expression (LGBTQIA++).
- Damages property or misuses equipment intentionally or through repeated negligence.
- Engages in illegal or prohibited activity on gym premises.
Members whose memberships are terminated for any of the reasons above are not entitled to refunds for dues, initiation fees, or other charges. Any unpaid balances remain due immediately.
If the termination is temporary (suspension), the member may return once the issue is resolved and any outstanding balances or corrective actions are completed.
7. Right to Appeal
If you believe your membership was terminated or suspended in error, you may submit a written appeal to management within 7 business days. Management will review the matter in good faith and provide a written decision.
